The Dutch Senate has approved the Wet toelating terbeschikkingstelling van arbeidskrachten, or Wtta.

From 1 January 2027, staffing agencies and other businesses that supply employees to clients will need authorisation from the new Dutch Labour Lending Market Authority, the Nederlandse Autoriteit Uitleenmarkt.

To obtain authorisation, labour suppliers will generally need to:

• provide a certificate of conduct;
• pay a financial security deposit of €100,000;
• demonstrate compliance with wage, tax and employment legislation;
• undergo periodic inspections.

Businesses wishing to continue supplying personnel must register before the new system enters into force.

Enforcement by the Netherlands Labour Authority is scheduled to begin on 1 January 2028. Both unauthorised labour suppliers and clients using them may be fined.

The new regime makes it increasingly important for companies to verify that their staffing and employment partners operate through a compliant structure.
